
Examples of successful cases
Case 1.
Mr J came to us with his claim for impact damage to his house. A JCB had been maliciously driven into the property causing some £40,000 worth of damage. The insurers had repudiated the claim on the basis of the non-nondisclosure of a previous theft claim, some 5 years ago, when the insured were at their previous property. It was clear, also, that they did not believe the loss to be fortuitous, although they had no evidence to the contrary.
After pursuing this matter direct with the insurer at Lloyds they accepted that their decision was wrong and have now agreed to deal with the claim in full.
Case 2
A large private dwelling was completely destroyed by fire. The insurers adamantly refused to deal with the claim offering no reason other than they were unhappy that this was the second fire in as many years. In fact, reinstatement following the first fire was still incomplete when the second fire occurred. Insurers were influenced by a planning approval for demolition of flats but this had been in place for ten years. As with the first fire, the insured only sought reinstatement as before the fire, not seeking to gain from it. Solicitors appointed by the insured made little headway and cost him more money. Our involvement concentrated on the evidence and our persistence paid off. There should never really have been any doubt that this was a genuine claim and the insurers agreed to rebuild the house at a cost of £400,000.
